2. The petitioner may move the Circle Officer, Belchhi, Patna for removal of alleged encroachment along with the name of the alleged encroachers and if such an application is filed then the Circle Officer will first verify whether there is any encroachment or not and if he finds that there is any encroachment then he can initiate an encroachment case.

3. If the Circle Officer finds that there is no encroachment then the Circle Officer will not initiate any encroachment case.

4. Any order adverse to anybody shall only be passed by the Circle Officer after hearing all the concerned parties.

5. With the aforesaid directions, this application stands disposed of.
