====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 05-10-2015 The sole petitioner apprehending his arrest in connection with Kako P.S. Case No. 67 of 2015 registered for the offence under Section 341, 323, 324, 337, 338, 307, 379, 504 and 34 of the Indian Penal Code has prayed for grant of anticipatory bail.
On perusal of the record it is evident that there was case and counter case between the parties. The first case was lodged from the petitioner's side as Kako P.S. Case No. 66 of 2015 which was registered for the offence under Section 341, 325, 307, 504 and 34 of the Indian Penal Code against the informant of the present case and others. In the present case besides the petitioner other persons were also made accused. It further appears from Annexure - '3' to the petition that this petitioner in the said occurrence had received injuries. Keeping
Patna High Court Cr.Misc. No.46993 of 2015 (2) dt.05-10-2015 2/2 in view the fact that it is a case and counter case between the parties and the fact that other four accused persons have already been granted anticipatory bail by the court below, the court is of the opinion that it is a fit case for extending the privilege of anticipatory bail to the petitioner. Accordingly in the event of arrest or surrender within a period of eight weeks from today the petitioner Parmanand Prasad @ Parmanand Yadav shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad, DistrictJehanabad in connection with Kako P.S. Case No. 67 of 2015 under conditions as contemplated under Section 438(2) of the Code of Criminal Procedure.
