ANJANA MISHRA ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Maheshkhunt P.S.Case No. 129 of 2014 registered under Sections 406, 409, 420, 469, 468, 471 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though there is clear allegation against the petitioner but the same is not made out as the petitioner had left the Company in the year 2010 itself. It is further submitted that the petitioner is a patient of AIDS and has been taking treatment since the year 2010 itself. It is further submitted that the Company in question closed down in the year 2013 whereas the petitioner had already left the same in 2010

Considering the aforementioned facts and circumstances, history of illness of the petitioner and also that he has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender in the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each in connection with Maheshkhunt P.S.Case No. 129 of 2014 to the satisfaction of the Chief Judicial Magistrate, Khagaria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
