JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-05-2023 The present writ petition has been filed seeking the following relief:- "That this writ petition is being filed for a direction upon the respondents to remove encroachment made at large scale over the land recorded in C.S.

Khatiyan as Gairmajarua "Dagar land"

situated on C.S. Plot no.513 in Mohalla Bagtaz Khan Pokhra, Ward no.6, situated in Hajipur Nagar Parishad (Vaishali) commonly known as Subhash Chowk Road which has been encroached by the

Patna High Court CWJC No.14122 of 2022(2) dt.09-05-2023 2/3 persons of vested interest by erecting permanent structure on the land of Road causing great inconvenience to the public at large as road has become narrow and traffic flow has been disrupted."

Considering the nature of relief sought for in the present writ petition, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Executive Officer, Nagar Parishad, Hajipur (Vaishali) for redressal of his aforesaid grievances. Liberty so sought is granted. It is needless to state that in case appropriate petition is filed, within a period of two weeks from today, appropriate action/decision shall be taken by the Executive Officer, Hajipur (Vaishali), in accordance with law, within a period of six weeks, thereafter.

Accordingly, the present writ petition stands disposed off as not pressed.
