The petitioner seeks bail in a case instituted for the offence under Sections 400, 401, 307, 353, 413 and 414 of the Indian Penal Code.

It is alleged in the written report that on getting secret information that group of Nut have assembled to commit crime, the police team reached near Nand Lal College, Daudpur and caught one person attempting to run away on seeing the police party, who disclosed his name as Gautam Nut @ Guljara (petitioner). It is alleged that he confessed that on 05.09.2016 at Daudpur market, he along with his other associates had committed theft in R.R. Jewellery by cutting the shutter of jewellery shop and

Police went to the shop of Chandan Kumar and recovered gold and silver ornaments in huge quantity and a diary in which he has mentioned about the articles purchased by the Nut group. Co-accused Chandan Kumar also disclosed that he has purchased the ornaments from Gautam Nut @ Guljara but no any T.I. Parade was ever held of those articles recovered from the shop to substantiate that those theft articles was sold by the petitioner. Petitioner is said to be in custody since 17.10.2016. Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Saran at Chapra, in connection with Daudpur P.S. Case No. 142 of 2016, subject to the condition that both the bailors will be the close relative of the petitioner. (Sanjay Priya, J.) ravi/- U T
