JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-03-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under sections 341, 323, 504, 326 and 307/34 of the I.P.C; later on section 302 of the I.P.C. was added. Allegedly, after sprinkling patrol on the mother Saraswati Devi the petitioner set her on fire resulting during treatment mother of the petitioner died. The father was also injured.

Submission is of false implication and that the petitioner has committed no offence, due to the land dispute with younger brother and the parents he has been implicated in this case, there was no incriminating material at the place of

Patna High Court Cr.Misc. No.1537 of 2017 (3) dt.16-03-2017 2/2 occurrence and as such the petitioner deserves sympathetic consideration, to which the learned A.P.P. seriously opposes. In the facts and circumstances as stated above, considering the nature of allegation, serious, I am not inclined to release the petitioner on bail and accordingly his such prayer stands rejected in connection with Kadwa P.S. Case No. 63 of 2016 pending in the court of A.C.J.M.-IVth, Katihar. (Jitendra Mohan Sharma, J) Abhay/- U T
