Petitioner apprehends his arrest in connection with Rajpur P.S.Case No. 333 of 2017, arising out of POCSO case no. 47 of 2017, registered for the offences punishable under Sections 376, 313/34 of the Indian Penal Code and 12 of POCSO Act. Allegation against the petitioner is of committing rape upon a minor girl on the promise of marriage and for miscarriage of her pregnancy.

Submission of learned counsel for the petitioner is that the case has been lodged by Child Welfare Committed and not by the victim and there was love affair between them. Heard learned APP also.

Having heard both sides and in view of allegation, I am

Patna High Court Cr.Misc. No.13064 of 2018 (2) dt.05-04-2018 2/2 not inclined to grant anticipatory bail to the petitioner. He should surrender and pray for regular bail, which shall be considered on its own merit.
