JUSTICE PURNENDU SINGH ORAL ORDER 12-09-2025 Heard Mr. Birendra Kumar, learned counsel appearing on behalf of the petitioner and Mr. Kumar Veerendra Narayan, learned APP appearing on behalf of the State.
2. The petitioner seeks modification of the order dated 30.04.2025 passed in Cr. Misc.23264 of 2025 in connection with Thali P.S. Case No. 45 of 2025 for further extension of time to surrender before the learned District Court.
3. Considering the fact that the petitioner seeks modification in the order dated 30.04.2025, in which four weeks time was granted to surrender before the learned District Court but as per the oral information given by Mr. Birendra Kumar, learned counsel appearing on behalf of the petitioner that sometime was consumed in receiving the report by the learned
Patna High Court CR. MISC. No.54391 of 2025(3) dt.12-09-2025 2/2 District Court, in such circumstances the time is required to be extended. Mr. Birendra Kumar, learned counsel for the petitioner, just wanted to misplace this simple fact, as if the concerned Judicial Officer has deliberately refused to understand the content of the order, particularly para-7 of the order dated 30.04.2025 passed in Cr. Misc.23264 of 2025. Such action of the counsel is deprecating and he must not indulge into misleading the Court to obtain any order.
4. However, considering the facts and circumstances of the case, time to surrender before the learned District Court is extended for further four weeks from today. Accordingly, the modification application stands disposed of.
5. The other part of the order dated 30.04.2025 passed in Cr. Misc.23264 of 2025 shall remain intact. (Purnendu Singh, J) Ashishsingh/- U T
