The petitioner apprehends his arrest in connection with P.S. Case No. 164 of 2011 registered for offences punishable under Sections 41,42, 52 of the Indian Forest Act, 1927 and Under Sections 5, 7, 8, 9 and 10 of the Bihar Kastha Chiran Act, 1990. Accusation is that on receiving secret information about establishing and running the saw mill by Yogendra Sharma in village- Farka, the informant being the Forest Official reached there and seized two wheels with pulley iron plate, iron blade and two piece Sisum wood.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.2466 of 2017 (2) dt.02-03-2017 2/2 petitioner has applied for license to establish saw mill on 16.06.2011 in the office of Divisional Forest Officer and also purchased parts of saw Mill to run the Saw Mill on obtaining the license to the Forest Department but with ulterior motive, the present case has been lodged by the informant. Having considered the facts and circumstances of the case, let the petitioner, above named, be enlarged on bail in the event of his arrest or surrender within six weeks on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- 13, Bhagalpur in connection with P. S. Case No. 164 of 2011, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure (Rajendra Kumar Mishra, J) Sudha/- U T
