Petitioner apprehends his arrest in a case filed under Section 420 of the Indian Penal Code.

As per the allegation, the petitioner received an amount of Rs.9,35,000/-, however, out of that 2,50,000/- was received through cheque. It is contended that apart from that, Rs.1,00,000/- was also received through another cheque but neither the cheque number nor any detail has been given

Patna High Court Cr.Misc. No.47474 of 2015 (4) dt.08-03-2016 2 / 3 in the complaint case. Learned counsel for the petitioner submits that the petitioner is ready to deposit Rs.5,00,000/-. Having regards to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in complaint case no.1481 (C) of 2015, the above named petitioner, Dharmendra Kumar shall be released on provisional bail for six weeks on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri Anant Kumar, J.M. 1st Class, Patna subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure with a further condition that at the time of furnishing bail bond, the petitioner would also be required to deposit Rs.2,50,000/- and the complainant would be at liberty to withdraw the aforesaid amount. Thereafter, the petitioner would be required to deposit another amount of Rs.2,50,000/- within six weeks thereafter.

However, the aforesaid deposit would be subject to the final result of the concerned case and without prejudice to the stand of the complainant which would be taken in the trial.

If the petitioner deposits the aforesaid amount
