JUSTICE SANJAY PRIYA ORAL ORDER 23-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Section 394 of the Indian Penal Code.

It is alleged that on the date of occurrence while the informant was returning to his house by his motorcycle, three motorcycle borne criminals overtook, restrained him and slapped and snatched Rs.200/-, a mobile phone and also took away his motorcycle.

The learned A.P.P. after perusal of the case diary has stated that the witnesses in paragraphs 36 and 37 have raised suspicion against the petitioner and other witnesses stated that the petitioner was found chatting with the informant. Besides this,

Patna High Court Cr.Misc. No.44619 of 2016 (3) dt.23-01-2017 2/2 there is no any specific overt act alleged against the petitioner. It has been submitted on behalf of the petitioner that the petitioner has clean antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner in the event of surrender, named above, within six weeks from the date of receipt of this order, in connection with Pipra P.S. Case No. 169 of 2013, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri J. Kumar, learned Judicial Magistrate, Supaul, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
