JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-02-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in custody since 3.1.2016 in Ganga Bridge P.S. Case No.53/14 under Sections 147, 148, 149, 341, 323, 427, 504, 307, 302 of I.P.C. and 27 of the Arms Act. Learned counsel appearing on behalf of the petitioner submits that earlier prayer for bail of the petitioner had been rejected vide order dated 29.4.2016 passed in Cr. Misc. No.9642/16.

Further submission is that it would appear from the F.I.R. that this petitioner along with his two brothers, namely, Sanjeet Rai Praveen Kumar on the order of their father opened fire

Patna High Court Cr.Misc. No.3627 of 2017 (2) dt.08-02-2017 2/2 from Katta causing injury to Arvind Rai, nephew of the informant, Sujit Rai also made firing on him on account of which he died. But only one fire arm injury was found on the person of the deceased.

In view of the above and the petitioner is in custody since 3.1.2016, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Vaishali at Hajipur, in Ganga Bridge P.S. Case No.53/14.
