JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-02-2018 Heard learned counsel for the petitioners and State. The petitioners apprehend their arrest in connection with Simri P.S. case no. 187 of 2017 for the offence under Sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners submits that before lodging of the present F.I.R. one another F.I.R. was lodged by daughter of petitioner no.2 and sister of petitioner no.1 against the informant's family and as such he submits that in the present case both side have filed case against each other. He submits that no case under Section 307 of the Indian Penal Code is made out and the allegation of snatching of money by petitioner no.1 is only designed to make the allegation

Having regard to the fact that the petitioners have no criminal antecedent, as per statement made in para 3 of the petition and the fact that the petitioners and informant are covillagers, the petitioners, named above, in the event of arrest or surrender before the court below within one month from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Simri P.S. case no. 187 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
