JUSTICE SANJAY PRIYA ORAL ORDER 3/ 21-02-2018 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner apprehends his arrest in Gaurichak P.S. Case No.291 of 2017 instituted for the offence under Section(s) 420, 120-B Indian Penal Code pending in the Court of the Additional Chief Judicial Magistrate, V, Patna City. Counsel for the petitioner has submitted that it is matter of civil dispute.

Counsel for the informant has appeared and submitted that the petitioner from the very beginning had intention to cheat the informant and introduced himself to the informant as son of Basudev Singh and also executed sale deed in

Patna High Court Cr.Misc. No.4331 of 2018 (3) dt.21-02-2018 2/2 favour of the informant after receiving consideration amount of rupees thirty two lac forty thousand by showing himself in the sale deed as Ajay Singh son of Basudev Singh. When the informant went to take possession of the land, objection was raised and the informant learnt that petitioner is not the son of Basudev Singh and he is son of Sugambar Singh and he has cheated the informant. Family members of Basudev Singh also told the informant that this petitioner is not the son of Basudev Singh.

In such circumstances, there is serious allegation against the petitioner of committing misrepresentation and fraud with the informant.

Prayer of the petitioner for grant of anticipatory bail is rejected.
