The petitioners apprehend their arrest in connection with Muffasil P.S. Case No. 116 of 2015 registered under Sections 302, 201, 120(B)/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners submits that final form has already been submitted in this case and on perusal of paragraph nos. 62, 63, 64 and 65 of the case diary, it appears that the wife of the deceased and other witnesses claimed to be eye witnesses and even they signed as
Patna High Court Cr.Misc. No.45636 of 2016 (4) dt.21-02-2017 2/2 witnesses at the time of preparation of Inquest Report, but they disclosed the same after three months of the alleged occurrence. Further submission is that the injuries were found antemortem in nature and caused by impact of heavy hard and blunt objects and its crushing impact due to train accident.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the J.M., 1st Class, Begusarai in connection with Muffasil P.S. Case No. 116 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shailendra/- U T
