JUSTICE SHIVAJI PANDEY ORAL ORDER 22-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking bail in connection with S.Tr. No. 118 of 2016 arising out of Dehri (T) P.S. Case No. 249 of 2015 registered for offences under sections 147, 148, 149, 341, 342, 302, 452 and 380/120(B) of the Indian Penal Code.

The petitioner had earlier moved before this Court in Cr. Misc. No.8076 of 2016 and this Court, vide order dated 21.4.2016, rejected the prayer for bail of the petitioner with an observation to the court below to conclude the trial within a period of nine months. The status report shows that five witnesses have been examined. Sangeeta Kumari who is the Informant in this case

Patna High Court Cr.Misc. No.4706 of 2017 (3) dt.22-02-2017 has also been examined including others and all have been turned hostile.

In that view of the matter, let the petitioner, namely, Jhabar Yadav @ Sanjeet Kumar Singh @ Sanjeet Kumar Yadav, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Rohtas at Sasaram in connection with S. Tr. No. 118/2016 arising out of Dehri (T) P.S. Case No. 249 of 2015.

The court below is directed to conclude the trial without unnecessary delay.
