The petitioner apprehends his arrest in connection with Pipra Kothi P.S. Case No. 200 of 2016 arising out of G.R. Case No. 6165 of 2016 registered under Sections 272, 273 of the Indian Penal Code and section 30(A) of the Bihar Prohibition and Excise Act, 2016.
Allegation against the petitioner, in brief, is that from the house of the petitioner 72 bottles of foreign liquor, each containing 750 M.L. were recovered.
The learned counsel appearing on behalf of the petitioner submits that the recovery was not made from the possession of the petitioner and on the alleged date of recovery, he was under medical treatment.
Considering the huge volume of recovery of foreign liquor, I am not inclined to admit the petitioner on anticipatory bail in connection with Pipra Kothi P.S. Case No. 200 of 2016, arising out of G.R. Case No. 6165 of 2016, pending in the court of
Patna High Court Cr.Misc. No.5371 of 2017 (2) dt.06-02-2017 2/2 learned C.J.M., Motihari, East Champaran.
However, if the petitioner surrenders in the court below and seeks regular bail, then the same shall be considered on its own merit without being prejudiced by this order. (Arun Kumar, J) BTiwary/- U T
