JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-10-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Narpatganj P.S. Case No. 257 of 2015 registered under Sections 406 and 420 of the Indian Penal Code. The accusation is that the petitioners went to the house of the complainant/informant and took him for doing the work of labourer for cutting and dressing the grapes plant in Maharashtra, but the payment was not made after finishing the work.

Learned counsel appearing on behalf of the petitioners submits that in fact, the informant made request to the petitioners to give loan of Rs. 10,000/- but the petitioners were not

Patna High Court Cr.Misc. No.44535 of 2016 (2) dt.27-10-2016 2/2 ready to give him loan. Due to that reason, this false case has been lodged by the informant. Moreover, petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Araria in connection with Narpatganj P.S. Case No. 257 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
