JUSTICE RAKESH KUMAR ORAL ORDER 13-02-2018 Heard Shri Krishna Prasad Singh, learned senior counsel, assisted by Shri Sada Nand Roy, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, apprehending his arrest in Nasriganj P.S. Case No. 190 of 2017 registered for offence under Section 409, 419, 420, 467 & 468 of the Indian Penal Code, 1860 has prayed for grant of bail in the event of his arrest or surrender. It was submitted by learned senior counsel for the petitioner that petitioner has been made victim since the main accused who has misappropriated the amount has already left for heavenly abode and thereafter petitioner being the sole person in the Bank has been made accused.
Patna High Court Cr.Misc. No.7089 of 2018(2) dt.13-02-2018 2/2 However, fact remains that it is case of defalcation of more than rupees ten crores and petitioner is the only named accused in the FIR. I do not find any ground to extend the privilege of anticipatory bail.
The petition stands dismissed.
