For the Petitioner/s : Mr. Ashok Kumar Mishra For the Opposite Party/s : Mr. Sri Kanhaiya Kishore ====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-12-2016 Heard learned counsel for the parties.
This application seeking cancellation of anticipatory bail granted to Opposite parties No. 2 and 3 has been filed by the petitioner, who is informant of Biraul P.S. Case No. 321 of 2016. It is alleged against them that they had attempted to commit rape on the informant. The sole ground, which has been taken in this application seeking cancellation of bail is that the said Opposite parties are publicly announcing in case the matter is not compromised, they would destroy her prestige. A complaint to this effect is said to have been filed by the petitioner in the Court of learned A.C.J.M, Biraul.
I have perused the said petition. The statement to this
effect is completely vague. It has been informed by the learned counsel for the petitioner that the police upon completion of investigation have already submitted charge-sheet; therefore, there is no question of tampering with the evidence in course of investigation, since the investigation is complete. This application has no merit and is, accordingly, dismissed.
