The petitioner has filed the instant application for grant of anticipatory bail apprehending her arrest in a case registered for the offence under sections 304B, 120B and 34 of the Indian Penal Code.

As per allegation in the F.I.R., the daughter of the informant, who was married about six years back to Niraj Kumar Yadav, is said to have been done to death by her husband, his younger brother and his mother.

It is submitted by learned Senior counsel for the petitioner that the petitioner, who is 60 years old lady, resides with her elder son, who works in the colliery at Dhanbad, while the deceased along with her husband were residing in Chandi

Patna High Court CR. MISC. No.50692 of 2019(5) dt.14-02-2020 2/2 village. It is further submitted that the allegations as per the F.I.R are general and omnibus in nature and the petitioner has no criminal antecedent.

The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the above stated facts and circumstances of the case, including the fact that the petitioner is 60 years old lady and the allegations are general and omnibus in nature, the court is inclined to enlarge the petitioner on bail. The petitioner, above named, in the event of her arrest or surrender in the Court below within a period of six weeks from today in connection with Chandi P.S. Case No.60 of 2019 is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XII, Bhojpur at Ara, subject to the conditions as laid down in section 438(2) of the Criminal Procedure Code.
