Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Kadamkuan P.S. Case No. 249 of 2022 lodged under Sections 25(1-b)a, 26 of the Arms Act.

As per the prosecution case, the recovery of one country made loaded pistol has been recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner is in custody since 22.05.2022. Counsel submits that 7 months have already been lapsed, charge sheet has already been filed as well as charge has also been framed in this case.

Patna High Court CR. MISC. No.53775 of 2022(2) dt.22-12-2022 2/2 Counsel submits that there are 3 criminal antecedents of the petitioner and he is on bail in all the 3 cases. Learned counsel for the State opposes the prayer for bail and submits that only 7 months has lapsed and there is criminal antecedent of the petitioner.

In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner at present but liberty is hereby granted that he may renew his prayer for bail 2 months from today and the Trial Court is directed to release him on bail imposing its own conditions so that he may not evade his appearance during trial. Trial Court is directed to expedite the trial as earliest as possible.

With this observation, the bail application stands rejected.
