JUSTICE SUDHIR SINGH ORAL ORDER 01-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Section 304B/34 of the Indian Penal Code. Allegation against the petitioner is that he along with other family members had killed the deceased Renu Devi due to non-fulfilment of demand of dowry.
It is submitted on behalf of the petitioner that he has got no criminal antecedent. He has falsely been implicated in the present case. There is no eye witness to the alleged occurrence. There is no direct or indirect evidence against the petitioner. On behalf of the State, it is submitted that petitioner is named in the F.I.R. and he is husband of the deceased and he had actively participated in the alleged occurrence. Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner, same is rejected.
Any how, the petitioner is directed to surrender in the court below, i.e., learned Judicial Magistrate, Ist Class,
Patna High Court Cr.Misc. No.48384 of 2015 (3) dt.01-02-2016 2 / 2 Aurangabad, in connection with Kasma P. S. Case no. 22 of 2015 within a period of six weeks and pray for regular bail which shall be considered and disposed of on its own merit without being prejudiced by this order.
