The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 379, 307/34 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case is that the petitioner along with Sanjay Thakur came and demanded money for pursuing the case. The petitioner put rope around the neck of the informant when some persons came to rescue then the petitioner resorted to fire.
It is submitted by learned counsel for the petitioner that for a petty dispute the accusation has been
Patna High Court Cr.Misc. No.49719 of 2015 (2) dt.05-11-2015 2/2 levelled. The injury report reflects one abrasion of marginal size, swelling with bruise at lower lip and loss of sensation at leg due to injuries. The injuries have been found to be simple in nature. Considering the nature of injury, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Dalsingsarai at Samastipur in connection with Vidyapati Nagar P.S. Case No. 110 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
