This application for grant of anticipatory bail arises out of Case No. 132C/2 of 2016, disclosing offence under Sections 47a and e of the Bihar Excise (Amendment) Act.
Considering the nature of allegation made in the First Information Report and the fact that 75 litres of semi prepared country made liquour was recovered from the place under the petitioner's possession, I am not inclined to grant the privilege of anticipatory bail to the petitioner.
Accordingly, this application for anticipatory bail is, hereby, rejected.
Patna High Court Cr.Misc. No.40772 of 2016 (2) dt.22-09-2016 2/2 The petitioner is directed to surrender before the court below within two weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
