====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 14-08-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 06.06.2019 in a case for the offence registered under Sections 363 and 364/34 of the IPC.

The prosecution story, in brief, is that Prahlad Prasad (petitioner) taken the grand-son (Pawan Kumar) of the informant from her house in course of going to Jharjhari with loaded Kari-Balli for guidance of Rasta and who was prohibited to down from the vehicle. After some distance, 4-5 unknown persons riding on Motorcycle, kidnapped her grand-son. It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged

Patna High Court CR. MISC. No.50452 of 2019(2) dt.14-08-2019 2/2 against the petitioner. The petitioner has falsely been implicated in the present case. The victim has been recovered. His statement under Section 164 Cr. P.C. has been recorded. It is alleged that co-accused Sudhir Yadav is alleged to have got the victim forcibly married to his daughter. As far as this petitioner is concerned, the victim has nothing specifically alleged against him.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Ist, Hilsa, Nalanda, in connection with Karai Parsurai P.S. Case No. 85 of 2019.
