The petitioners seek bail in Aurangabad Town P.S. Case No. 253 of 2016 instituted for the offence under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-b), a, 26, 35 of the Arms Act.
It is alleged that from the place of seizure, one country made pistol and other articles were recovered from the possession of petitioner no. 1. Beside this, some other articles have been recovered from a bag which was jointly recovered from the possession of the petitioners.
Patna High Court Cr.Misc. No.3068 of 2017 (2) dt.06-02-2017 2/2 It has been submitted on behalf of the petitioners that petitioners are in custody since 22.08.2016. It has been mentioned in para 3 of the petition that petitioners have no criminal antecedent.
Keeping in view of the period spent by the petitioners in the custody and petitioners having no criminal antecedent, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case No. 253 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioners.
