Petitioners are apprehending their arrest in connection with a case registered for the offence under Section 307 and other allied Sections of the Penal Code. They are named in the First Information Report lodged preceding a land dispute. Petitioner no. 2 is said to have assaulted the wife of the informant causing fracture of her leg, in the circumstances, he does not deserve grant of bail in the event of arrest. He is directed to surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the Court below and apply for regular bail, which should be considered in
Patna High Court Cr.Misc. No.48185 of 2015 (2) dt.02-11-2015 2/2 accordance with law.
So far petitioner nos. 1 and 3 are concerned, they are said to have inflicted simple injuries. Petitioner no. 1 being 72 years of age and petitioner no. 3 being his son are also directed to surrender in the court below within the aforesaid time and thereafter be released on bail on furnishing bail bonds of Rs. 5,000/-(Rs. Five Thousand ) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Saharsa in connection with Basanahi P.S. Case No. 03/2015, subject to the conditions laid down under Section 438(2) Cr.P.C. This petition is, accordingly, disposed of.
