JUSTICE SATYAVRAT VERMA ORAL ORDER 04-01-2023 Heard learned counsel for the petitioners, learned counsel for the informant and learned A.P.P. for the State. The petitioners seek bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 504, 506, 379 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioners submits that the petitioners are in custody since 02.07.2022 and are persons with clean antecedent.
The informant alleges that 15 named accused persons including the petitioners came and on orders of Ashish

No.54049 of 2022(2) dt.04-01-2023 2/3 Ranjan, accused persons including the petitioners assaulted by gadasa, lathi etc., causing fracture of leg and the informant also suffered bodily injury, thereafter, it is alleged that Suraj Bhan snatched gold chain from his neck. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case, it is next submitted that allegation of assault is general and omnibus in nature and as far as allegation of snatching golden chain from the neck of the informant is alleged against Rahman, the same is ornamental in nature. Learned A.P.P.
for the State and learned counsel for the informant opposed the prayer for bail of the petitioners but are not able to meet the submission of the learned counsel for the petitioners that the allegation of assault is general and omnibus nature, it is also submitted that specific allegation of assault by gadasa is against Ashish Ranjan Giri that he assaulted on head of the informant. Considering the fact that the petitioners are in custody since 02.07.
Patna High Court CR. MISC. No.54049 of 2022(2) dt.04-01-2023 3/3 let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Obra P.S. Case No. 12 of 2022.
