JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-04-2018 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.
This is an application for grant of anticipatory bail in connection with Dhamdaha P.S. Case No. 95 of 2013 for the offence registered under Sections 147, 148, 149, 307, 302, 201, 120B and 504 of the Indian Penal Code.
After some arguments, the learned counsel for the petitioners seeks to withdraw the present petition as far as the petitioner nos. 4 and 5 are concerned.
Accordingly, the present petition qua the petitioner nos. 4 and 5, is disposed of as withdrawn.
The allegation is regarding a mob having attacked the prosecution side and the husband of the informant is said to have

It is submitted by the learned counsel for the petitioner nos. 1 to 3 that they are ladies and apart from the fact that nothing has come against them in the case diary, they cannot have probably lifted and thrown the husband of the informant in the fire. It is further stated that the petitioners are having a clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioner nos. 1 to 3, namely, Dana Devi, Gulo Devi and Bugiya Devi to the privilege of anticipatory bail in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Dhamdaha P.S. Case No. 95 of 2013 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
