Petitioner is apprehending his arrest in connection with a complaint case lodged by his vendor seven years after the execution of sale-deed on the ground that he has been stopped from cultivating the vended land by one Bindeshwari Yadav to whom also petitioner conveyed other portion of the same plot. There appears to be boundary dispute between the complaint herein and said Bindesiwari Yadav.

Be that as it may, let petitioner, named above, surrender in the court below within four

Patna High Court Cr.Misc. No.40181 of 2015 (2) dt.05-10-2015 weeks from the date of receipt/production of a copy of this order in the court below, thereafter be released on bail on furnishing bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Complaint Case No. 83(c) of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
