Petitioner apprehends his arrest in connection with Rampur P.S.Case No. 366 of 2017 registered for the offences punishable under Sections 420 and 406/34 of the Indian Penal Code.

Allegation against the petitioners is of taking loan from the Bank under Prime Minister Rojgar Yojna and he has not paid the amount Rs.4,35,125.00.

Submission of learned counsel for the petitioner is that due to illness of his mother he could not deposit the said amount and he is ready to deposit the same if some reasonable time is granted to him.

Heard learned APP also.

Patna High Court Cr.Misc. No.14127 of 2018 (2) dt.10-04-2018 2/2 Having heard both sides and in the facts and circumstances, this application is disposed of with a direction to the petitioner to surrender within a period of six weeks from the receipt of this order with a Bank Draft of Rs.1,35,125/- and if such amount is deposited he shall be released on provisional bail to the satisfaction of court below and rest of the amount he has to pay in three equal instalmentlets payable on monthly basis on or before 7th of every month, otherwise his bail bond shall be cancelled. It is made clear that once the total amount is deposited, learned court below will confirm his bail bond and the deposit of amount will be subject to result of the case.
