The petitioner seeks bail in Noor Sarai P.S. Case No. 329 of 2018, instituted for the offence under Section(s) 302 and 120B/34 of the Indian Penal Code.
It is alleged in the written report that daughter of the informant namely, Rishu Kumari (since deceased) had gone to attend marriage ceremony of villager Bibhishan Paswan and did not return. Later on, her dead body has been recovered. The informant raised suspicion against five co-accused persons as named in the written report. The co-accused Sonu Kumar has disclosed the name of petitioner and his father-in-law namely, Sanjit Paswan before the police.
Counsel for the petitioner submits that petitioner is
Patna High Court CR. MISC. No.49895 of 2019(2) dt.17-08-2019 2/2 not named in the written report. He is in custody since 20.12.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Noor Sarai P.S.
