JUSTICE SANJAY PRIYA ORAL ORDER 20-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 409 and 420 of the Indian Penal Code.

The Block Development Officer, Raniganj, alleged that Mukhiyas and Panchayat Secretary of Gram Panchayat Raj, Hasanpur, Hasa Gram Panchayat and Barbanna committed financial irregularities and misappropriated the government money in different schemes. The petitioner was Panchayat Secretary of Hasa Panchayat.

It has been submitted that three accused persons (Mukhiyas) of Hasanpur Panchayat, Hasa Panchayat and

No.45069 of 2016 (3) dt.20-01-2017 2/2 Barbanna Panchayat and Panchayat Secretary of Hasanpur Panchayat have already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 5.8.2016, 14.9.2016 and 24.11.2016 passed in Cr. Misc. Nos. 20012 of 2016, 30262 of 2016 and 45654 of 2016 respectively.

The learned A.P.P. has pointed out the statement of the witnesses in paragraphs 33, 34 and 35 of the case diary wherein it is clearly mentioned that the work has already been completed.

Considering the aforesaid facts and circumstances of the case as also that the other co-accused persons have already been granted bail, let the petitioner in the event of surrender, named above, within six weeks from the date of receipt of this order, in connection with Raniganj P.S. Case No. 283 of 2015, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Araria, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
