Petitioner seeks bail in Mahila P.S. Case No.36 of 2016 instituted under Section(s) 376 Indian Penal Code and Section 3, 4 of the Protection of Children from Sexual Offences Act, pending in the Court of the 1st Additional Sessions Judgecum-Special Court, POCSO Act, Saran at Chapra. It is alleged against this petitioner that he committed rape with the victim girl, who is an orphan and was brought to his house by his wife while she was sitting at Siwan Junction. The victim girl gave statement under Section 164 Cr. P.C., wherein, she has alleged specific allegation against this petitioner of committing rape with her. Medical report of the

Patna High Court Cr.Misc. No.3681 of 2017 (4) dt.23-03-2017 2/2 victim is available in the case diary, wherein, the doctor has stated that sexual intercourse cannot be ruled out.

In the aforesaid circumstances and looking into the serious allegation against the petitioner, I am not inclined to grant bail to the Petitioner at this stage.

Prayer for bail is rejected.

The petitioner may renew his prayer for bail after six months if no substantive progress is made in the case. (Sanjay Priya, J) JA/- U T
