JUSTICE SUDHIR SINGH ORAL ORDER 01-02-2016 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Charpokhri P.S. Case No. 135 of 2015 for the offences instituted under Sections 341, 323 and 307/34 of the IPC. Later on, Section 304(B) and 120(B) of the IPC were also added. The prosecution story, in brief, is that the petitioner alongwith other co-accused persons assaulted the informant and set her on fire by sparingly Kerosene Oil of her body. The informant died while undergoing treatment.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is Bhaisur of the deceased and he has falsely

On behalf of the State it has been submitted that the petitioner is named in the F.I.R. and FIR is the dying declaration of the deceased whereas specific allegation has been made against him.

Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected in Charpokhri P.S. Case No. 135/2015, pending in the court of the learned S.D.J.M., Ara.
