JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Barh P.S. Case No. 185 of 2016 registered under Sections 392 and 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. rather in course of investigation, Ravi Kumar, Bhima @ Bhima Mahto and Lalmohan Rai confessed their guilt and disclosed the name of this petitioner having hand in the present case. Later on, petitioner was apprehended by the police and remanded in the present case, except that there is nothing against the petitioner showing his involvement in the present case. Patna High Court Cr.Misc. No.2400 of 2017 (2) dt.03-02-2017 petitioner is accused in Ghoshwari P.S. Case No. 43 of 2016, in which, he is on bail and in the present case he is in custody since 29.06.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Barh, Patna, in connection with Barh P.S.
