====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 04-01-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 1.12.2021, it is next submitted that petitioner has antecedent of two cases.
The informant alleges that accused persons including the petitioner intercepted him and looted Rs. 1,52,276/- along with other articles as detailed in the FIR and the petitioner on the orders of Pankaj even fired.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next
Patna High Court CR. MISC. No.54145 of 2022(3) dt.04-01-2023 2/2 submitted that allegation of firing is ornamental as no one was injured, it is also submitted that Pankaj Kumar has been granted Regular Bail by Order Dated 01.02.2022 in Cr. Misc. No. 47222 of 2021.
Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Rajepur P.S. Case No. 159 of 2020.
Further, if the learned court below comes to a conclusion that after release the petitioner is trying to delay the trial, the court below shall forthwith cancel his bail bonds after recording reasons.
