JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Begusarai Town P.S. Case No. 195 of 2016, registered under Sections 399, 402 of the Indian Penal Code, Section 25(1-b)a, 26/35 of the Arms Act and Section 53(B), 54 of Bihar Excise Act, 2016.

The accusation is that on receiving secret information about gathering of miscreants near N.H. 31 for making preparation of committing dacoity. Thereafter, Police reached there and apprehended six persons, including the petitioner. On search, a country made pistol with a live cartridge and a bottle, containing 180 ML India made foreign

Patna High Court Cr.Misc. No.3927 of 2017 (2) dt.23-02-2017 2/2 liquor, etc. recovered from the possession of the petitioner. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in this case. The petitioner is accused in six other cases, but he is on bail in all cases and in this case petitioner is in custody since 23.04.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 195 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
