The petitioner has prayed for bail in a case registered for the offence punishable under sections 393, 414, 402 of the Indian Penal Code.

As per allegation in the FIR, on getting secret information about loot and snatching by 3-4 accused persons with help of lathi and danda, police party proceeded towards spot and on seeing them, they started to escape but one accused, namely Nitish Kumar was apprehended. He disclosed the name of the petitioner as one of his associates along with other four accused persons.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.54302 of 2022(3) dt.17-01-2023 2/2 that petitioner has been falsely implicated in this case. General and omnibus allegation has been levelled against the petitioner. No looted article has been recovered from his possession. In confessional statement of apprehended co-accused, petitioner's name transpired, which has got no evidentiary value in the eye of law. Petitioner is languishing in judicial custody since 01.04.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SDJM, Khagaria in connection with Mansi P.S. Case No. 161 of 2021, G.R. No. 1691 of 2021.
