Petitioner apprehends his arrest in connection with Ghosi P.S.Case No. 311 of 2017 registered for the offences punishable under Sections 409/34 of the Indian Penal Code. Allegation against the petitioner is that he could not save the pipal tree which was handed over to Dafadar and Chaukidar and petitioner has to save the same and it was found that all the persons misappropriate the aforesaid tree.

Submission of learned counsel for the petitioner is that only on suspicion he has been made accused in this case and he is a contractor.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.14138 of 2018 (2) dt.10-04-2018 2/2 circumstances, let the petitioner, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad, in connection with Ghosi P.S.Case No. 311 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
