The petitioner prays for Anticipatory bail in Rosera P.S. Case No. 162 of 2015, registered under Sections 302/34 of the Indian Penal Code. It is stated that upon conclusion of investigation case was found true under Section 306 I.P.C. For the hanging of the deceased the father lodged the case against unknown persons. Several weeks thereafter he made statement, suspecting hands of Gotia including the petitioner in the commission of crime.
It is stated that co-accused Savitri Devi who is aunt of the deceased has been granted anticipatory bail vide order dated 08.04.2016, (Annexure-2.) Petitioner has no criminal antecedent. Merely on suspicion raised several weeks after the occurrence he is suspected as an accused. Considering the above, I am persuaded to extend him the privilege of anticipatory bail. Patna High Court Cr.Misc. No.37651 of 2016 (3) dt.24-11-2016 2/2 below within four weeks, the petitioner above named, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M., Rosera, Samastipur in connection with Rosera P.S. Case No. 162 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C. with the further following conditions. (i) One of the bailors shall be the own/close family members of the petitioner.
(ii) In case of framing of charge, the petitioners shall appear in person on each and every date fixed in the court below. In case of default in doing so on two consecutives occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioners and secure his arrest in accordance with law.
