The petitioner apprehends his arrest in a case registered for the offences punishable under Section 323 and other Sections of the Indian Penal Code and under Sections 3/4 of the Dowry Prohibition Act.
The informant alleged that the petitioner took Rs. 75,000/- from her for marriage of her daughter with son of the petitioner, but later on the petitioner demanded Rs. One lakh more and a motorcycle for settlement of marriage of his son with the daughter of the informant.
It is submitted that the informant is co-villager of the petitioner and only to pressurize the petitioner to get his son married with the daughter of the informant this false case has been
Patna High Court Cr.Misc. No.40620 of 2015 (2) dt.06-10-2015 2/2 filed. There is no material to show that the petitioner ever received in any money as dowry from the informant.
Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in Teghra P.S. Case No. 127 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
