JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Jamobazar P.S. Case No. 84 of 2019 registered for the offences under Sections 272, 273, 308/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Prosecution story is that police got information that petitioner has engaged in the liquor trade and kept liquor in the orchard and on such information police raided the orchard and two persons succeeded in fleeing away, one of them is the petitioner and from orchard 70.45 litres of liquor was recovered. Submission of learned counsel for the petitioner is that the orchard does not belong to the petitioner and he has falsely been implicated.

Heard learned APP, who has opposed the prayer for

Patna High Court CR. MISC. No.49886 of 2019(2) dt.09-08-2019 2/2 anticipatory bail on the ground that of maintainability of this application for grant of anticipatory bail.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner.

Accordingly, this application is dismissed.
