The petitioners pray for grant of anticipatory bail in a case registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code. As per allegation, petitioner nos 1 and 7 entered into the house of the informant and assaulted the informant, his daughter-in-law and nephew and thereafter, it is alleged that all accused persons assaulted as a result of which they received injuries.
It is submitted on behalf of petitioner that there is case and counter case between the parties. The occurrence took place due to land dispute. Injured have sustained abrasion, pain and swelling. Petitioners claim clean antecedent. Learned counsel for the State opposes the prayer for anticipatory bail.
Considering the facts and circumstances of the case, in the event of arrest/ surrender within four weeks from today, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate II, East Champaran, Motihari in Paharpur P. S. Case no. 154 of 2021 subject to condition as laid down under section 438(2)
