This is a petition for grant of anticipatory bail for offence under Sections 420, 409 and 34 of the Indian Penal Code. The petitioner was Secretary of the school.

Allegation is that in collusion with the headmaster, petitioner withdrew rupees eleven lakh and odd meant for construction of the school building, but, the school building was not constructed. Submission of the petitioner is that the headmaster was allowed regular bail by this Court on his undertaking that he would complete the construction of the building work within six months from the date of release vide order, dated 27.09.2016, passed in Cr. Misc. No. 40338 of 2016.

Considering the aforesaid fact that the petitioner, above named, is a female, she in the event of her arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Bhargama P.S. Case No. 20 of 2016 to the satisfaction of Sri Kumar Amit, Additional Chief

Patna High Court Cr.Misc. No.50643 of 2016 (3) dt.14-12-2016 Judicial Magistrate, Araria, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code with the condition that the petitioner shall report to the Court below regarding the completion of the construction of the school building within six months, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
