The petitioner seeks bail in Town Motihari P.S. Case No. 523 of 2021, registered for the offence punishable under Sections 457, 380 of the Indian Penal Code.

On the basis of CCTV footage this petitioner and other co-accused persons are alleged to have committed theft of ornaments and cash of the informant.

It is submitted on behalf of the petitioner that no looted article has been recovered from possession of this petitioner. Till date petitioner has not been put on test identification parade and only on CCTV footage he has been made accused in this case. Though it is alleged that cash of Rs. 2500/- has been recovered from possession of this petitioner but the same is not stolen and belongs to this petitioner. Petitioner is
