The petitioner is languishing in custody in a case registered for the offences punishable under Sections 363, 366/34 of the Indian Penal Code and Section 8 of the POCSO Act.

It is alleged by the informant that minor daughter of the informant was kidnapped by all the F.I.R named accused persons including the petitioner. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named

Patna High Court CR. MISC. No.54290 of 2022(3) dt.01-05-2023 2/2 in the F.I.R. The victim in her statement recorded under Section 164 Cr.P.C has stated that she herself left the house and went along with the co-accused Mumtaz on her own sweet-will and performed the marriage with Mumtaz. She has not alleged any allegation against the petitioner. The petitioner is languishing in custody since 09.06.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. In the facts and circumstance of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VIcum-Special Judge(POCSO Act) Sitamarhi in connection with Bathnaha P.S. Case No. 65 of 2022.
