JUSTICE BIRENDRA KUMAR ORAL ORDER 08-12-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 324, 354, 379 of the Indian Penal Code.

The petitioners, allegedly, entered into the house of the informant and committed assault and theft as well as attempted to outrage the modesty of the family members. Submission is that the informant is in the habit of lodging false case against the neighbours which would be evident from Annexure-3 series.

Considering the nature of allegation, let the

No.52476 of 2016 (2) dt.08-12-2016 petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran/Successor Court in connection with Turkauliya (Banjariya) Police Station Case No. 842 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
