====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 22-08-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 365, 370, 370A, 372, 373, 376, 120B/34 of the Indian Penal Code, Sections 3, 4, 5, 6 of the Immoral Traffic Act, Sections 4, 6 of the POCSO Act and Section 75 of the Juvenile Justice Act.

Petitioner was apprehended by the police while, in the house of the petitioner, immoral human trafficking was going on. Husband of the petitioner is also an co-accused in this case. Petitioner has stated on oath that she has got no criminal antecedent.

Submission is that the petitioner is accused simply for the reason that she is wife of the co-accused. The victim-girls have not stated anything against the petitioner in her statement recorded under

Patna High Court CR. MISC. No.49966 of 2019(2) dt.22-08-2019 2/2 Section 164 Cr.P.C.

Considering the entire facts, let the petitioner, above named, be released on bail after completion of investigation of the case against the petitioner on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sitamarhi Police Station Case No. 281 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
